Pokke Terms of Service & Generative AI Policy

Welcome to Pokke ("the Application", "the Service"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Auralis Studio ("we", "us", "our", or "the Company"), governing your download, access, and use of the Pokke mobile application, companion websites (pokke.app), and associated synchronization features.

By launching, installing, downloading, or using Pokke, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must discontinue using Pokke and uninstall the application immediately.

1. 100% User Ownership of Generated Content

We believe that your thoughts, prompts, and machine-generated outputs belong solely to you:

  1. Full Intellectual Property Rights: You retain 100% ownership, copyright, and title to all prompts, text, images, code, documents, and instructions input into Pokke, as well as all generated responses and artifacts produced by on-phone models.
  2. Zero Licensing Claims by Company: Auralis Studio asserts no copyright, ownership, or intellectual property rights over your generated content. We do not use your inputs or outputs to train commercial foundation models or algorithms.
  3. Responsibility for Use: Because inference executes locally on your hardware, you are solely responsible for verifying the legality, copyright compliance, and real-world application of any generated materials.

2. On-Phone Execution & AI Output Disclaimers

Pokke serves as an on-phone execution runtime engine for Small Language Models (SLMs) and neural networks utilizing the llama.cpp mobile framework.

  1. Third-Party Model Weights: Models available via the Model Hub are authored and published by independent third-party researchers and organizations (such as Meta AI, Mistral AI, Alibaba Cloud, Microsoft Research, Google, and Hugging Face contributors). Auralis Studio does not author, train, or curate third-party weights.
  2. Hallucination & Inaccuracy Warning: Neural networks operate through probabilistic mathematical token sampling. Generated responses may contain factual errors, outdated claims, biased commentary, or hallucinations.
  3. No Professional Advice: Model outputs must never be relied upon as professional medical diagnosis, legal counsel, or critical financial advice. Always seek independent guidance from qualified licensed professionals before taking action based on AI-generated responses.
  4. "As-Is" Software Provision: Pokke and the inference engine are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

You agree not to use Pokke or any downloaded model weights to engage in prohibited activities, including:

4. Message-Level Content Reporting & Moderation

In strict compliance with Google Play Generative AI Policy, Pokke implements user-driven safety mechanisms:

  1. In-App Report System: Users can flag any assistant response using the report flag icon (⚑) located directly next to the message.
  2. Report Scope: Reporting captures the specific problematic assistant response snippet and the immediately preceding prompt, alongside model metadata (e.g., model name, quantization format) and violation category (Harmful advice, Hate speech, Dangerous content, Sexual content, Copyright, Other).
  3. Review & Enforcement: Reports are transmitted securely over TLS to our administrative review database (content_reports). Auralis Studio reserves the right to review flagged responses, publish model compatibility advisories, notify upstream model authors, or remove problematic model presets from the public Model Hub.

5. Phone Safety, Thermals & Battery Safeguards

  1. High-Performance Compute: Executing billion-parameter neural networks on mobile silicon (GPUs, NPUs, and multi-core CPUs) produces sustained phone heat and accelerates battery drain.
  2. Built-In Safeguards: Pokke integrates dynamic thermal monitoring and automatically throttles execution speeds or suspends passes if your phone's internal battery thermistor exceeds safe operating thresholds.
  3. Hardware Limitation: Auralis Studio is not liable for phone wear, physical degradation, or temporary thermal throttling resulting from extended compute runs.

6. Community Edition & Pokke Pro Terms

  1. Community Edition (Free Forever): Core on-phone chat, Hugging Face downloads, and local hardware profiling are 100% free with zero advertisements, zero subscriptions, and zero artificial message throttling.
  2. Pokke Pro (Lifetime Unlock): Advanced power features (client-side share password hashing, custom link expiry timers, offline document exports, and local LAN OpenAI-compatible API servers) are unlocked via a one-time lifetime in-app purchase without recurring billing cycles.

7. Model Licenses & Attribution

Third-party models downloaded via the Model Hub remain governed by their creators' upstream licenses (e.g., Meta Llama 3 Community License Agreement, Apache License 2.0, MIT License). By downloading models, you agree to comply with their respective acceptable use agreements.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Auralis Studio, its directors, employees, or partners be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the application, model outputs, or inability to run inference.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Auralis Studio is registered, without regard to its conflict of law principles.
