# Pokke Terms of Service & Generative AI Policy Effective: September 22, 2026 Last updated: September 22, 2026 These Terms of Service govern your use of the Pokke mobile application, [pokke.app](https://pokke.app), and related sync features provided by Auralis Studio ("we," "us," or "our"). By installing, downloading, or using Pokke, you agree to these Terms and our [Privacy Policy](/privacy). If you do not agree, do not use the app and uninstall it. --- ## 1. Content Ownership You own all inputs (prompts, text, images, code, and documents) you provide to Pokke, as well as any text, code, or other outputs generated by on-device models. Auralis Studio claims no copyright, ownership, or intellectual property rights over your content. We do not use your inputs or outputs to train AI models. Because models run locally on your device, you are responsible for how you use generated materials and for verifying their accuracy, legality, and copyright compliance. --- ## 2. On-Device Models & AI Disclaimers Pokke runs Small Language Models (SLMs) and neural networks directly on your device using `llama.cpp`. 1. **Third-party models:** Models available in the Model Hub are created and distributed by third parties, such as Meta AI, Mistral AI, Alibaba Cloud, Microsoft Research, Google, and Hugging Face contributors. Auralis Studio does not author, train, or curate these weights. 2. **Inaccuracies and hallucinations:** Language models generate text probabilistically. Responses may contain factual errors, outdated information, bias, or hallucinations. 3. **No professional advice:** Generated responses are not medical, legal, or financial advice. Always consult a qualified professional before making decisions based on AI output. 4. **As-is software:** Pokke and the local inference engine are provided "as is" and "as available," without warranties of any kind, express or implied. --- ## 3. Acceptable Use You may not use Pokke or downloaded models to: - Create child sexual abuse material (CSAM), non-consensual sexual content, violent extremism, or material promoting illegal acts. - Create malware, exploits, spyware, or ransomware. - Impersonate others, create deceptive content for election interference, or carry out fraud. - Harass, threaten, defame, or infringe on the intellectual property of any person or organization. --- ## 4. Content Reporting & Moderation In line with Google Play Generative AI requirements, Pokke includes reporting tools for generated content: 1. **In-app reporting:** You can flag any assistant response using the flag icon (`⚑`) next to the message. 2. **What reports include:** Reports send the flagged response, the prompt immediately preceding it, model metadata (such as model name and quantization format), and the selected category (harmful advice, hate speech, dangerous content, sexual content, copyright, or other). 3. **Review and enforcement:** Reports are sent securely via TLS. We review flagged responses and may publish model advisories, report issues to model authors, or remove models from the public Model Hub. --- ## 5. Device Heat and Battery Usage 1. **Hardware load:** Running language models on your device's processors generates significant heat and drains battery faster than typical apps. 2. **Built-in safeguards:** Pokke monitors battery temperature and will throttle or pause generation if the device exceeds safe operating temperatures. 3. **Liability:** Auralis Studio is not responsible for device wear, battery degradation, or thermal throttling resulting from running models. --- ## 6. Pokke Editions & Billing 1. **Standard Edition:** On-device chat, Hugging Face downloads, and hardware profiling are free, without ads, subscriptions, or message limits. 2. **Pokke Pro:** Advanced features—such as password-protected link sharing, custom link expiration timers, offline document exports, and a local OpenAI-compatible API server—are unlocked through a one-time in-app purchase. 3. **No recurring fees:** Pokke Pro does not charge monthly or annual subscriptions. 4. **Refunds:** In-app purchases are handled through Google Play In-App Billing and follow Google Play refund policies. --- ## 7. Model Licenses Third-party models downloaded through the Model Hub are governed by their original licenses (such as the Meta Llama 3 Community License Agreement, Apache 2.0, or MIT). By downloading a model, you agree to comply with its license terms and acceptable use policies. --- ## 8. Limitation of Liability To the fullest extent permitted by law, Auralis Studio and its directors, employees, and partners are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the app, reliance on model outputs, or inability to run models. --- ## 9. Governing Law These Terms are governed by the laws of the jurisdiction where Auralis Studio is registered, without regard to conflict of law principles. Any dispute arising under these Terms will be resolved through good-faith negotiation or binding arbitration. --- ## 10.
